This policy explains how Garg Trading Co. ("we"), which sells and licenses Bahi-Khata by CrossKloud, handles personal data in connection with Bahi-Khata by CrossKloud (the "Software"). It is written with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 in mind.
1. Your business data stays on your computer
The Software runs on your own computer. Your invoices, clients, products, expenses, purchases, settings and backups are stored there, in the Software's data folder. We do not receive, collect, host or have access to this data. For that data, you (not we) decide what is collected and why, and you are responsible for it under the law, including for the personal data of your own customers.
2. When the Software connects to the internet
The Software works offline. It connects to the internet only in these cases:
- Update check. It asks our update server whether a newer version exists. This sends your computer's IP address and the Software's version number, nothing from your data.
- Google Drive backup, if you turn it on. Backups are uploaded to your own Google account. They go to Google, not to us, under Google's privacy policy. You can turn this off at any time.
- Fonts. The interface may load fonts from Google Fonts, which receives your IP address.
- Links and sharing you start. Opening a link (for example to the GST portal), or sharing an invoice on WhatsApp or by email, sends what you choose to that service.
The Software contains no advertising and no analytics or tracking.
3. What we do collect
We collect only what we need to sell and support the Software:
- Purchase and licence details: name, business name, GSTIN, email, phone, billing address and payment records, to issue your licence and GST invoice and to meet tax and accounting law.
- Support communications: what you send us by email, phone or chat, and anything you choose to show us during a remote support session (which we start only with your permission).
We use this data to provide the licence, support and updates you paid for, to send you service messages about the Software, and to comply with law. We do not sell it. We share it only with service providers who help us run our business (such as payment gateways and email providers) under confidentiality obligations, or where the law requires.
4. How long we keep it
We keep purchase and invoice records for as long as tax and accounting law requires (generally eight years under GST), and support communications for as long as needed to support you, after which we delete them.
5. Your rights
Under the Digital Personal Data Protection Act, 2023 you may ask us to:
- tell you what personal data of yours we hold and how we use it;
- correct, complete or update it;
- erase it, where we no longer need it for the purpose it was collected or to meet a legal obligation;
- withdraw consent you gave, without affecting processing already done;
- nominate another person to exercise these rights if you die or become incapable.
Write to [email protected]. We will reply within a reasonable time and in any case within the time the law requires.
6. Security
We protect the data we hold with reasonable security practices. The security of the data stored by the Software on your computer, and of your backups, is in your control: use a password-protected user account, keep your computer updated, and keep backups safe.
7. Children
The Software is meant for businesses. We do not knowingly collect personal data of children.
8. Grievances
For any question or complaint about your personal data, contact our grievance officer at [email protected]. If you are not satisfied with our response, you may approach the Data Protection Board of India.
9. Changes
We may update this policy. The date at the top shows the current version. If a change materially affects you, the Software will ask you to review it.
